Businessman Raj Kundra has recorded composed notes in anticipatory bail application at the Bombay High Court, regarding the porn case including Poonam Pandey and Sherlyn Chopra. The Court, last week deferred the consultation for the situation for Monday, November 22. In his composed notes, Kundra’s legitimate group headed by Advocate Prashant Patil and Advocate Swapnil Ambure expressed those sections, 67, and 67(A) of the IT Act are not appropriate for the situation.
Kundra was asked by the Bombay High Court about the two sections that have been forced for the situation. In the Cyber cell police case, just these two sections are non-bailable. The remainder of the sections claimed for the situation are bailable.
Section 67 of the act talks about punishment for publishing or transmitting obscene material in electronic form, and Section 67A talks about punishment for publishing or transmitting material containing sexually explicit acts, etc., in electronic form.
